Transparency Plan

Governor Phil Scott released his Administration’s plan for public disclosure of records relating to EB-5 projects in the Northeast Kingdom in connection with alleged fraud case against Ariel Quiros and Bill Stenger.

Redaction

Pursuant to the Disclosure Plan for Records (the Plan) relating to EB-5 projects in the Northeast Kingdom, approved by the Governor, the Department of Financial Regulation issued a Request for Proposal for the redaction of personally identifying information (PII) and other confidential information from documents related to the Jay Peak EB-5 projects. The documents in need of redaction of PII are part of pending litigation (State v. Ariel Quiros, et al., Dkt. No. 217-4-16 Wncv).  Under the Plan, the state will file a motion with the court to rule the non-privileged records from the state’s files discoverable under the Vermont Access to Public Records Act and, if the motion is granted, will produce the records. To do so, the PII must be redacted before the records may be disclosed to the public.  

On January 19, 2018, the state and Percipient, LLC entered into a contract for the de-identification of personally identifiable information from Jay Peak related records.
